These Terms of Service (“Terms”) govern your access to and use of the TattooForm platform (“Service”) operated by:
(hereinafter referred to as “TattooForm”, “we”, “us”, or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. The Service
TattooForm is a B2B SaaS platform that enables tattoo artists and studios to create client intake forms, collect booking inquiries, manage submissions, and build a micro-site with portfolio and contact information. We provide the technical infrastructure; you are responsible for how you use it and for your relationship with your clients.
We may use analytics tools (currently Google Analytics 4) within the dashboard application to understand how the Service is used and to improve it. Analytics are only activated after you explicitly consent via the cookie banner displayed in the application. For full details see our Privacy Policy.
2. Eligibility and Accounts
- ·You must be at least 18 years old to create an account.
- ·You must provide accurate and complete information during registration and keep it up to date.
- ·You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- ·One person or entity may not operate multiple free accounts.
- ·You are responsible for all activity that occurs under your account, including any actions taken by third parties who access your account due to your failure to maintain the security of your credentials.
3. Acceptable Use
You agree not to use the Service to:
- ·Collect data from minors (persons under 18 years of age) without verifiable parental consent, where required by applicable law.
- ·Send unsolicited communications (spam) to clients or any third parties.
- ·Upload content that is illegal, obscene, defamatory, or infringes third-party intellectual property rights.
- ·Reverse-engineer, decompile, scrape, or otherwise misuse the platform or its underlying technology.
- ·Impersonate another artist, studio, or person.
- ·Interfere with or disrupt the Service, its servers, or connected networks.
- ·Use the Service in any way that violates applicable laws or regulations, including data protection and privacy laws.
- ·Use automated systems (bots, scrapers) to access the Service without our prior written consent.
We reserve the right to suspend or terminate your account if you violate these Terms.
4. Subscriptions and Billing
4.1 Payment Processing — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com (Paddle.com Market Limited). Paddle is the Merchant of Record for all TattooForm orders. This means that when you purchase a paid plan, your contract for payment is with Paddle. Paddle handles all payment processing, invoicing, tax calculation, collection, and remittance. Paddle provides customer service for payment-related inquiries and handles refund requests.
By purchasing a paid plan, you also agree to Paddle's Buyer Terms. Your payment data is processed by Paddle in accordance with Paddle's Privacy Policy.
4.2 Plans and Pricing
- ·Free plan features are provided at no cost and may be changed or limited at any time with reasonable notice.
- ·Paid plans are billed monthly or annually via Paddle.
- ·Prices are displayed in PLN (Polish Zloty) or EUR depending on your language/region preference, and are inclusive of applicable taxes as calculated by Paddle.
- ·We reserve the right to change pricing with at least 30 days' prior notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
4.3 Subscription Renewals and Cancellation
- ·Subscriptions renew automatically at the end of each billing period.
- ·You can cancel your subscription at any time via the Paddle billing portal. Cancellation takes effect at the end of the current billing period.
- ·No refunds are issued for partial billing periods unless required by applicable law.
4.4 EU Consumer Right of Withdrawal
If you are an EU/EEA consumer, you may have a 14-day right of withdrawal from the date of purchase. However, by subscribing and accessing the digital Service immediately, you acknowledge that you consent to immediate performance and that you lose your right of withdrawal once access to the Service has been provided.
5. Plan Limits and Usage
Each plan (Free, paid tiers) includes specific usage limits such as the number of active forms, submissions per month, or other feature restrictions as described on our Pricing page.
- ·Usage limits reset on the 1st day of each calendar month at 00:00 UTC.
- ·If you exceed the limits of your plan during a calendar month, certain features may become restricted until the next reset or until you upgrade your plan.
- ·We reserve the right to modify plan limits with reasonable notice.
6. Data, Privacy, and Your Responsibilities as Data Controller
Your use of the Service is also governed by our Privacy Policy.
As a TattooForm user (artist or studio), you are the data controller for any personal data you collect from your clients via TattooForm forms. This means:
- ·You are responsible for having a lawful basis (such as consent) to collect that data.
- ·You are responsible for honouring your clients' GDPR rights upon request (access, rectification, erasure, etc.).
- ·You must not use the data collected via TattooForm for purposes other than those disclosed to your clients.
- ·You acknowledge that you must inform your clients about how their data will be processed, including that TattooForm is used as a processor.
7. Data Retention
- ·Client submissions are retained for a maximum of 2 years from the date of submission. After this period, submissions are automatically deleted. You may delete individual submissions at any time before that.
- ·Uploaded images (reference images from client submissions) are retained for a maximum of 30 days from the date of upload, after which they are automatically and permanently deleted.
- ·Account data is retained until you delete your account.
- ·Payment records are retained by Paddle as required by applicable tax and accounting laws.

8. Intellectual Property
- ·Your content: You retain ownership of all content you upload (portfolio images, form configurations, bio text, etc.). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and transmit it solely for the purpose of operating the Service.
- ·Our platform: We retain all rights to the TattooForm software, design, branding, trademarks, and all associated intellectual property. These Terms do not grant you any right to use TattooForm's name, logo, or branding except as necessary to use the Service.
9. Availability, Modifications, and Maintenance
We aim for high availability but do not guarantee uninterrupted, error-free access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable advance notice for material changes that affect the functionality available to paid subscribers.
Scheduled maintenance windows will be communicated in advance where feasible. We are not liable for any temporary unavailability resulting from maintenance, updates, or circumstances beyond our reasonable control.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or expectations.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- ·TattooForm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of revenue, data, business, or anticipated savings.
- ·Our total aggregate liability for any claim arising under or in connection with these Terms or the Service shall not exceed the total amount you paid to us (via Paddle) in the three (3) months immediately preceding the event giving rise to the claim.
- ·Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
12. Indemnification
You agree to indemnify and hold harmless TattooForm and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights, including your clients' data protection rights.
13. Termination
- ·By you: You may delete your account at any time via Settings → Danger Zone. Upon deletion, your data will be removed in accordance with our Privacy Policy.
- ·By us: We may suspend or terminate your account immediately and without prior notice if you materially breach these Terms. For minor breaches, we will make reasonable efforts to notify you and provide an opportunity to remedy the breach before termination.
- ·Effect of termination: Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy and applicable data retention requirements.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and TattooForm regarding your use of the Service and supersede all prior agreements, understandings, and communications.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and provide notice via email or an in-app notification at least 30 days before the changes take effect for existing users. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
